Learning Legal Case: Freedom of Speech

Have you heard of People v. Larry Flynt, better known as Hustler v. Falwell case?

In his legal case Larry Flynt, a founder of Hustler magazine has published the statement against Falwell, who was a well known public figure and religious influencer. In this case Hustler magazine In his trial Larry Flynt wanted to prove that “freedom of speech doesn’t protect speech you like; it protects speech you don’t like”.

Fascinating closing statement by Larry’s attorney:

(Edward Norton) “Ladies and gentlemen of the jury, you have heard a lot today, and I’m not gonna go back over it, but you have to go into that room and make some decisions. But before you do, there’s something you need to know. I am not trying to suggest that you should like what Larry Flynt does. I don’t like what Larry Flynt does, but what I do like is the fact that I live in a country where you and I can make that decision for ourselves. I like the fact that I live in a country where I can pick up Hustler magazine and read it, or throw it in the garbage can if that’s where I think it belongs.”

People have found Larry Flynn guilty. Although initially losing the case on the state level, Larry Flynt challenged the case all the way to the Supreme Court, where he won!.

Jerry Falwell won the intentional infliction of emotional distress without showing that the publication by Hustler contained a false statement of him made with actual malice. However the Supreme Court surpassed has ruled for Hustler, protecting the First Amendment and freedom of speech.
