Criminal Law – Crime, Accomplice and Accessory
At Anthem Paralegal, of course we don’t like crime, but we are huge fans of Law and Order and criminal law in both professional and personal life. And we don’t only watch it as TV show. We practice it in real life.
Have you ever thought of how criminals get prosecuted and what differentiate a criminal from accomplice and accessory to the crime? Not much. Although the sentences may vary, they all can be prosecuted for the same felony. So who is criminal. Criminal is a person who committed a crime.
Accomplice to a crime in criminal law:
A person who knowingly, voluntarily, or intentionally gives assistance to another in or fails to prevent another from the commission of a crime. An accomplice is criminally liable to the same extent as the principal. This person is typically present when the crime is committed.
Accessory to the crime:
This person knows the person they were helping was going to commit a crime or did commit a crime. In general, being an accessory to the crime is a felony offense.
Accessory after the fact:
An accessory-after-the-fact is someone who assists a person who has committed a crime after the person has committed that crime, with knowledge that the person committed the crime, and with the intent to help the person avoid arrest or punishment. This person is mostly liable for obstruction of justice, but not for the crime committed.
